Strategic funding source, inc., dba kapitus, a fast-growing company providing small business financing, seeks an attorney with 4+ years of experience in financial services litigation or compliance to play an integral role in the company`s legal organization.
This position has a broad scope of workThe role is primarily dedicated to regulatory and compliance work, but the ideal candidate will also assist the general counsel with transactional and corporate tasksYou would be the fourth in-house lawyer, reporting to the deputy general counsel, and your responsibilities would primarily include:
General matters, litigation, and bankruptcy
As needed, assist general counsel and deputy general counsel in connection with:
Offensive and defensive litigation, including matters arising from company functions, financing agreements, bankruptcy proceedings initiated by individuals or small businesses, contract or employment disputes, as well as other matters
Supervision of outside counsel for matters outside of primary jurisdictions and in connection with larger matters and judgment domestication and enforcement
Assist in implementing judgement enforcement procedures and provide supervision in connection with the same
Assist in supervising team of paralegals in connection with subpoena compliance, litigation and judgment enforcement
Direct responsibility for assisting in general supervision of arlington, virginia office as a member of management team
Provide guidance to human resources on legal issues related to employment and personnel
Financial services compliance
As needed, assist general counsel and deputy general counsel in connection with:
Company policies and procedures, including assisting the general counsel, deputy general counsel, and compliance committee in formulating policy and guidelines for all applicable federal and state statutes related to commercial lending and financial services.
Research and identify relevant local, state, and federal law applicable or potentially applicable to the company and provide advice regarding compliance
Implement and update the company`s compliance policies, human resources policies, handbooks, and related procedures
Supervise outside counsel or experts retained to assist in the review and implementation of compliance policies
Develop training materials and make presentations to various departments regarding compliance obligations on an as needed basis
Coordinate the company response to federal, state, or local requests, audits, and subpoenas
Other compliance and regulatory assignments
Requirements
Jd with excellent academic and professional credentials
Member in good standing of either the new york or virginia bar, or eligible for admission upon motion
Independent, self-starter, and self-possessed with the ability to work independently
Flexible, with the ability to adjust to circumstances in a growing company and assist with projects on an as needed basis
Strong oral and written communication skills
Excellent presentation and training skills
Minimum four years` experience in complex litigation, investigations, and/or compliance counseling at us-based or international law firm, in government, or in-house with exposure and understanding of financial services and lending
Prior government experience at a financial regulator a plus
Judicial clerkship a plus
Familiarity with bankruptcy/creditor`s rights a plus
